This is a process whereby a chairperson is appointed to decide whether an employee is guilty of an alleged act of misconduct and, if so, to determine what the appropriate sanction should be. A neutral independent chairperson may be selected in place of a company employee to chair the enquiry, to ensure impartiality and that the process is run smoothly. Depending on the disciplinary code of the company, the chair of the disciplinary enquiry may either decide on the appropriate sanction, or can make a recommendation on sanction. Organisations usually use an internal manager to chair the enquiries. However, employers (often with encouragement from unions) are increasingly using external chairpersons from Tokiso because they are independent and credible.
